Welcome to LMI Couriers (ABN [Insert ABN], trading as LMI Couriers, accessible at lmicouriers.com.au. These Terms and Conditions (“Terms”) govern your use of our courier services, website, and related applications (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms, which form a legally enforceable contract. If you do not agree, please do not use our Services.

These Terms comply with the Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth), and nothing in these Terms is intended to exclude, restrict, or modify your rights under the ACL, including consumer guarantees.

1. Definitions

In these Terms:

  • “Company” means LMI Couriers, its employees, agents, subcontractors, and related entities.
  • “Customer” means the shipper, receiver, owner of the Goods, or any person for whom the Services are performed.
  • “Goods” means the items tendered for delivery, including packaging and pallets.
  • “Services” means the carriage, transport, handling, or any other service provided by LMI Couriers.

2. Use of Services

You agree to use the Services lawfully and in accordance with these Terms. You must be at least 18 years old or have the consent of a legal guardian to use our Services. You agree to:

  • Provide accurate and complete information when booking a delivery or creating an account.
  • Not use the Services to send prohibited or illegal items (see Section 4).
  • Not interfere with or disrupt the functionality of the Services.

LMI Couriers is not a common carrier and may refuse service at its discretion. Goods are carried at the Customer’s risk unless otherwise agreed in writing.

3. Australian Consumer Law and Consumer Guarantees

Under the ACL, our Services come with consumer guarantees that they will be provided with due care and skill, be fit for purpose, and be completed within a reasonable time. If we fail to meet these guarantees, you may be entitled to a remedy, such as a refund, repair, or resupply of the Services, depending on the nature of the failure.

Our liability for breach of a consumer guarantee is limited, where permitted by law, to resupplying the Service or paying the cost of having the Service resupplied. Nothing in these Terms excludes or limits your rights under the ACL.

4. Prohibited and Restricted Items

The following items are prohibited from being shipped through our Services, in accordance with the Australian Code for the Transport of Dangerous Goods by Road & Rail (ACDG) and other regulations:

  • Dangerous goods (e.g., explosives, flammable liquids, toxic substances).
  • Illegal items or substances.
  • Live animals or animal by-products prohibited by law.
  • Firearms, ammunition, or weapons.
  • Perishable goods without proper packaging.

If prohibited items are detected, they may be subject to non-collection, delay, return, or seizure by authorities, and you may incur additional fees.

5. Booking and Delivery

When booking a delivery, you agree to:

  • Provide accurate details about the sender, recipient, weight, dimensions, and contents of the Goods.
  • Ensure Goods are securely packed, labeled, and suitable for courier transport. LMI Couriers does not provide special handling for packages marked “fragile” or with orientation markings.
  • Pay all applicable fees, including delivery charges, taxes, customs duties, and surcharges.

We may inspect or open Goods at our discretion to ensure compliance with these Terms or applicable laws. Incorrect declarations (e.g., weight, dimensions, or contents) may incur additional charges, including a $25 administration fee and re-quoting based on corrected details. Futile collection charges apply if Goods are unavailable, unpackaged, or unlabeled at the agreed pickup time.

Delivery times are estimates and not guaranteed. We are not liable for delays due to factors beyond our control, such as weather, traffic, or incorrect recipient information.

Orders may be canceled with a full refund up until the Goods are collected. After collection, orders cannot be canceled.

6. Fees and Payment

You agree to pay all fees for the Services, including delivery charges, GST, customs duties, and any additional expenses (e.g., storage or futile collection fees). Fees are non-refundable unless a refund is required under the ACL (e.g., due to Service failure). Refunds for Service failures will be assessed case-by-case.

Payments must be made via the methods provided on our website. We use industry-standard encryption to protect payment information, which is not stored on our servers.

Accounts in arrears may accrue interest, and we may withhold Services until payment is received. Payment terms are the 20th of the month following the invoice date.

7. Liability and Insurance

LMI Couriers is not liable for loss or damage to Goods unless caused by our negligence or breach of consumer guarantees. Our liability is limited to the lesser of AUD $100 or the value of the Goods at the time of receipt, unless additional transit insurance is purchased.

Customers are responsible for insuring Goods. We recommend obtaining marine transit or similar insurance to cover loss or damage during handling and carriage.

Claims for loss or damage must be lodged in writing within 7 days of delivery or Service completion. Claims for non-delivery must be notified within 60 days of the expected delivery date. Legal proceedings must commence within 9 months of the Service date, in the state of New South Wales.

We are not liable for indirect, consequential, or incidental damages, including loss of profits, unless required by the ACL.

8. Account Responsibilities

If you create an account, you are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities conducted through your account.

Notify us immediately at support@lmicouriers.com.au if you suspect unauthorized access.

9. Termination

We may suspend or terminate your access to the Services for:

  • Violation of these Terms.
  • Fraudulent or illegal activity.
  • Non-payment of fees.

You may terminate your account by contacting us. Termination does not relieve you of outstanding payment obligations.

10. Intellectual Property

All content on our website, including logos, text, and images, is the property of LMI Couriers or its licensors and is protected by Australian copyright laws and international conventions. You may not use our content without prior written permission.

11. Indemnification

You agree to indemnify and hold LMI Couriers, its affiliates, and employees harmless from any claims, losses, or damages arising from your use of the Services, violation of these Terms, or shipment of prohibited items.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales, unless otherwise required by law.

Any claim or controversy arising from these Terms, except for actions seeking equitable relief, shall be settled by binding arbitration in Sydney, Australia, in accordance with the commercial arbitration rules of the Australian Disputes Centre.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the Services after changes constitutes your acceptance of the revised Terms.
